Privacy Statement for Partner Webshop

This privacy statement applies to the processing of personal data of Restaurant Partners that make use of Just Eat’s Partner Webshop. Unless otherwise stated, the data controller for processing these personal data is Group B.V. and/or the JET Affiliate (including the subsidiary companies of Just Eat N.V.)

At JET we are committed to building the world’s greatest food community, and that begins with protecting the privacy of everyone in our community. This means that we’ll protect the personal information of all visitors that make use of our Services.

What personal data we process and why
Personal Data, in this Statement also referred to as “your Data”, means any information or set of information from which we are able, directly or indirectly, to personally identify you, in particular by reference to an identifier, e.g. name and surname, email address, phone number, your resume, a reference letter, etc. It does not include data where the identity has been removed (anonymous data).

Whenever you interact with JET via our Services we collect and process your personal data. JET may process your personal data for the following purposes

1. Ordering process

We process the following personal data that is necessary to execute your order in our Partner Webshop, the legal basis for this processing of personal data is the performance of a contract with you. We process the following data for this purpose: 

  • (Company) name
  • Address details
  • Contact details
  • Chamber of commerce number, VAT number (where applicable)
  • Order data and transaction data
  • Payment details data

2. Customer services

When you contact our customer services department, we will use the personal data you provide to answer your question or handle your complaint. The legal basis for this processing of personal data is that it is needed for the performance of a contract and/or to comply with JET’s legal obligations as defined in the GDPR. We process the following personal data for customer service purposes:

  • Name
  • Address data (if applicable)
  • Contact data
  • Order and transaction data
  • Payment data (if applicable)
  • Comments (if applicable)

3. Account

To be able to order via our Partner Webshop you will have to register with an account. This account is necessary to make sure we only provide our services to our partner restaurants and others within the catering and hospitality sectors. 

If you are not a restaurant registered to our main platform we may ask you for your Chamber of commerce number and/or VAT number to make sure we are only providing our services to the catering and hospitality sectors. We process the following personal data to create and maintain your account:

  • (Company) name
  • Contact details
  • Chamber of commerce number (if applicable)
  • VAT number (if applicable)
  • Order data
  • Payment details data

4. Marketing messages

We also process your data in order to be able to send you (personalised) marketing messages. We process your personal data for these marketing purposes based on your consent,unless your consent is not required under applicable law. If you would like to change your preferences regarding receiving these messages and messages, you can unsubscribe via the unsubscribe link in the message or via our privacy form. We process the following data for marketing purposes:

  • (Company) Name
  • Address details
  • Contact details
  • Campaign details (optional)
  • Device ID (if applicable)
  • Cookie and technology data (if applicable)

5. Campaigns and competitions

JET also processes your personal data when you enter into one of our campaigns and/or competitions. We only process your personal data for campaigns and/or competitions if you’ve provided us with your consent. We process the following data for these campaigns and competitions:

  • Name
  • Contact details
  • Address details (if applicable)
  • Campaign contributions (if applicable)

6. Cookies

In addition, JET uses cookies for functional, analytical and marketing purposes. The functional cookies are necessary for the use of the website. The data from the analytical and marketing cookies are not linked to the other data you provide during the ordering process. Please refer to our Cookie Statement for more information about cookies.

Additional purposes

We will only use the data obtained via the Technologies for the purposes described above. If we want to use the data for a different purpose, we will take appropriate measures to inform you, consistent with the significance of the changes we make. Where required by applicable data protection law, we will obtain your consent.

Our website and vacancies are not intended for persons defined as underage by applicable local laws, nor do we intend to collect personal data of website visitors who are under the defined legal age. However, we are unable to verify visitors’ or applicants' ages. We therefore advise parents and/or legal guardians to monitor their children's online activities, to prevent their personal data being collected without parental consent. If you feel that we have collected personal data of a minor without consent, please contact us via our privacy form. We will then proceed to erase this data.

Automated decision making 

JET uses automated decision making and profiling to execute the agreement with you and to improve our platform. If you are a partner restaurant, JET uses your revenue data to set a spending cap based on the restaurant revenue and uses your restaurant data (e.g. kitchen type and menu) to provide you with a more personalized shopping experience. 

When such automated decision-making and/or profiling leads to a negative decision about you, and you do not agree with it, you can contact us via our privacy form. We will then proceed to reassess the situation. 

How long we store personal data for
We will only retain your personal data for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, tax, accounting, or reporting requirements. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

In some circumstances we may anonymise your personal data so that it can no longer be associated with you, in which case we may use such information without further notice to you.

Sharing of your personal data with others

JET may work and/or share data with other companies within the JET group and other third parties in order to carry out the processing described above. 

These group companies and third parties will process your personal data on behalf of us (as data processors) or as autonomous data controllers, and have access to your personal data for the purposes described in this Statement. We require group companies and third parties to protect it in accordance with the standards set out in this Statement and we take appropriate measures pursuant to the applicable data protection laws to ensure the same level of protection and confidentiality of your personal data.  

We will also share your data with other third parties where appropriate or required by applicable law or regulation (including a court order) or where we believe disclosure is necessary to exercise, establish or defend legal rights or to protect the vital interests of any person. Such third party controllers may include law enforcement agencies. 

We may also disclose your Data to any company or prospective buyer of all or substantially all of our assets in connection with any sale or transfer of those assets.

Your personal data may be shared with the following parties:

  • Service providers such as providers for software, hosting, application support, delivery, logistics, information security, etc.   
  • Implementation partners
  • Professional consultants
  • Governmental or regulatory authorities
  • Visa and tax authorities
  • Insurance companies
  • When applicable, with merchants, payment service providers, and such as Adyen (for their privacy statement please see here) which facilitate payment transactions 
  • Marketing service providers
  • Any other party provided that you have given your consent to the disclosure.

Third-party websites 

Our website may include links to third-party websites. When accessing such third-party websites, bear in mind that each of these websites has its own privacy statement. Although JET takes great care in selecting websites to link to, we cannot assume responsibility for the way in which they handle your data.

Information we obtain from third-party sources

Information that we obtain from third-party sources are analytics reports and market research surveys in order to:

  • measure the performance of marketing campaigns for our Services; and
  • better understand your preferences so that we customize our marketing campaigns and Services accordingly.

We also benefit from publicly available information from public authorities and local councils to verify that you have the correct license and certifications to run your Restaurant.

We make sure we have a legal basis to collect and use your personal information. The legal basis we rely on will change depending on the type of information and the context in which we collect it. Our main reason for collecting and using information obtained from third-party sources is to perform our contract with you, but we may also process it where it is in our legitimate business interests to do so in order to constantly improve our Services and make it even easier to partner with you.

Where your data gets sent 

We may transfer your personal data outside of the European Economic Area. This may include transferring it to or accessing it from other jurisdictions that may not provide a level of protection equivalent to the EU data protection laws. Where we transfer personal data we will take account of any applicable statutory obligations relevant to personal data transfers and, where there isn't a European Commission (EC) adequacy decision in place, we will rely on appropriate (security) safeguards, including EC approved standard contractual clauses. 

Rights, questions or complaints

We inform you that, with regard to the personal data, you can exercise the rights provided for by applicable data protection laws, which may include: 

  • The right to be informed: Obtain information about our collection and use of your personal data. 
  • The right to access: Get access to the personal data we hold about you, gain information on how your personal data is being processed by us and under certain conditions obtain a copy of your personal data undergoing processing. 
  • The right to verify the accuracy of your personal data: Request rectification if any of your personal data held by us is inaccurate, incomplete or requires an update. 
  • The right to be forgotten: Under certain circumstances you may have the right to ask us to delete or otherwise dispose of any of your personal data that we hold. 
  • The right to restrict (i.e. prevent) the processing of your personal data: If the requirements are met, we will not process your personal data for any purpose other than storing it.
  • The right to object to us using your personal data for a particular purpose(s):  We will stop processing your personal data upon your request if we process your personal data on another legal basis than consent.
  • The right to withdraw consent: If we are relying on your consent as the legal basis for using your personal data, you are free to withdraw that consent at any time. Your request will not prejudice the lawfulness of the processing based on the consent given prior to the withdrawal.
  • The right to data portability: If you have provided personal data to us directly, we are using it with your consent or for the performance of a contract, and that data is processed using automated means, you can ask us for a copy of that personal data in a structured, commonly used and machine-readable format (if technically feasible) to re-use with another service or business in many cases.
  • Rights relating to automated decision-making and profiling. 
  • Lodge a complaint: You have the right to bring a claim before your competent data protection authority. We would welcome the opportunity to resolve your concerns ourselves, however, so please contact us first.

Please keep in mind that email communications are not always secure. Therefore, please do not include sensitive information in your emails to us.

We will do our best to address your request in time and free of charge, except where it would require a disproportionate effort. In certain cases, we may ask you to verify your identity before we can act on your request.

It is important that your personal data is kept accurate and up-to-date. If any of the personal data we hold about you changes, please keep us informed as long as we have that data. If you share with us data of other people, it is your responsibility to collect such data in compliance with local legal requirements. For instance, you should inform such other people, whose data you provide to us, about the content of this Statement and obtain their prior consent.
